Draft. Pinpoint Flights is not open to the public yet. Items in [brackets] are filled in when the company and its registrations are in place, and this document will be reviewed by a lawyer before it takes effect.
1. Agreement
These terms govern your use of the Pinpoint Flights website and services (“Pinpoint Flights”, “we”, “us”), operated by Pinpoint Flights LLC, a Florida limited liability company. By using the site you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.
Pinpoint Flights is in beta. Features may change, searches may be slow or incomplete, and results may occasionally be wrong. Always check the details before you pay.
2. Who can use Pinpoint Flights
- You must be at least 18 and able to enter a binding contract. If you book for other people, you confirm you are authorised to do so and to accept these terms for them.
- The service is currently offered only to people in the United States. It is not yet available to residents of California, Hawaii, Iowa and Washington, which require separate seller-of-travel registrations; we will open those states as registrations are granted.
- You may use Pinpoint Flights for personal, non-commercial travel planning only.
3. What we do, and who sells your ticket
Pinpoint Flights searches flight prices from several sources and ranks them against the filters you set. Results come in two kinds:
- “Book here” fares. We sell these tickets to you as a travel agent. The fares come from the airline through our technology and ticketing partner, Duffel, and the airline issues the ticket. The airline operates the flight and its conditions of carriage apply to your journey.
- Everything else. For other results we are a search service only. Buttons such as “Find this fare on Aviasales” or “Exact itinerary at the seller” take you to another company's website. Your purchase there is with that company, under its terms and prices, and we are not a party to it.
We don't operate flights and aren't responsible for an airline's performance, including delays, cancellations, schedule changes, overbooking, lost baggage or service on board.
4. Prices, taxes and fees
- Prices are in US dollars and are the total for the travellers in your search, including taxes and mandatory carrier fees.
- Where you asked for checked bags, we add the bag fees to the price. If a bag fee is marked “est.”, it is our estimate from the airline's published fees and the airline's actual charge may differ.
- “Live airline fare” prices are the airline's current offer. “Google Flights price” results are current listings; the seller confirms the final price before you pay. Grid prices marked ~ are estimates for dates we haven't checked.
- Fares and availability change constantly. Airlines only hold a price for a short time, and a fare can sell out or change until your ticket is issued. We will always show you the final price before you pay.
- If we show a price that is plainly wrong (for example, a technical error), we may cancel the booking and refund you in full.
5. Booking with us
- Before you pay we check the fare with the airline again and show you the total, the fare conditions and the baggage allowance.
- Enter every traveller's name exactly as it appears on the passport or ID they will travel with. Airlines may refuse or charge for name corrections.
- Payment is taken by our payment processor on its secure page. We never see or store your full card number.
- Your booking is confirmed when you receive a booking reference from us. Keep it; the airline will ask for it.
- We may cancel a booking that we reasonably believe is fraudulent or made in breach of these terms, and will refund any payment for it.
6. Cancellations, changes and refunds
- 24-hour cancellation. For flights to, from or within the United States booked at least 7 days before departure, you can cancel a “Book here” booking within 24 hours of making it for a full refund, as US Department of Transportation rules provide.
- After that, changes and refunds follow the fare rules shown before you booked. Many fares can't be refunded; some can be changed for a fee plus any difference in fare.
- If the airline cancels or significantly changes your flight and you choose not to travel, you are entitled to a refund to your original payment method under US Department of Transportation rules. We will help you with it.
- We may charge a service fee for changes or cancellations you ask for, and if we do we will tell you the amount before you confirm. Airline penalties are separate.
- Refunds for bookings made through other websites are handled by the company you bought from.
7. Passports, visas and travel requirements
You are responsible for having a valid passport, any visas or transit visas, and meeting health and entry requirements for every country on your trip, including countries you only change planes in. Filters such as “avoid routes that need a transit visa” are a best-effort aid, not a guarantee. Check with the relevant embassy or government before you travel.
8. The search assistant
The “Tell us exactly what you want” box uses an AI model to turn your description into search filters. It can misunderstand you. Read the summary and the filters before you search; they, not your original text, decide the results. Don't enter sensitive personal information (such as passport numbers or health details) in the description.
9. How we make money (affiliate disclosure)
Searching is free. We earn money in two ways: a margin or service fee on “Book here” bookings, and referral commissions when you click through to some partners (such as Aviasales) and book there. Commissions never change the price you pay. Our ranking is based on price, travel time and the preferences you set, not on whether a result earns us money.
10. Acceptable use
You agree not to:
- use bots, scrapers or other automated means to search or copy content from the site, or send traffic intended to overload it;
- make speculative, false or fraudulent bookings, or book in someone else's name without their permission;
- get around rate limits, location restrictions or other security measures, or reverse engineer the service;
- use the site for any unlawful purpose.
We may limit, suspend or block access that breaks these rules.
11. Airlines and other third parties
Airlines, Duffel, payment processors and partner websites are independent companies with their own terms and privacy policies. Airline conditions of carriage and fare rules govern your flight. Links to other sites are provided for convenience; we don't control and aren't responsible for their content.
12. Our content
The site, its design and our software are owned by Pinpoint Flights LLC or our licensors. Airline names and logos belong to their owners and are used only to identify the airline. You may use the site for your own travel planning; you may not copy, resell or republish our content or results.
13. Disclaimers
Except where the law says otherwise, the site and search results are provided “as is” and “as available”. We don't guarantee that results are complete, that the cheapest or best fare will be found, or that the site will always be available or error-free. Nothing in these terms limits rights you have under consumer protection law or US Department of Transportation rules.
14. Limitation of liability
To the extent the law allows, Pinpoint Flights LLC is not liable for indirect, incidental, special or consequential losses, or for lost profits or missed travel caused by third parties. Our total liability for any claim about a booking is limited to the amount you paid us for that booking; for other claims it is limited to US$100. This doesn't limit liability that can't legally be limited, such as for fraud or gross negligence.
15. Indemnity
You agree to cover our reasonable losses and costs arising from your breach of these terms or misuse of the site, including false or fraudulent bookings.
16. Governing law and disputes
These terms are governed by the laws of the State of Florida and applicable US federal law. If you have a problem, contact us first at [[email protected]]; most issues can be sorted out quickly. If we can't resolve it, disputes will be decided by the state or federal courts located in [county] County, Florida, and you and we agree to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead.
17. Changes to these terms
We may update these terms. The version in effect when you make a booking applies to that booking. We will post changes here with a new effective date, and give notice of significant changes on the site.
